What will Alito and Thomas do this year?

If it looks like Dems are going to win the Senate, will they resign? With drumpf’s presidency going down the tubes, if Dems win the senate in 2026 and it looks likely the white house in 2028, Alito and Thomas will either have to commit themselves to serving at least through 2032 (hoping rethugs are back in power, but that is no guarantee for them), OR they have to resign this year so the rethugs can push through two more MAGA justices to solidify the court for another 20 years.

So what do you think they will do?

Resign during the summer?

Resign only after the election if the Dems win the Senate so the lame duck Senate can push two judges through?

Sign themselves up for potentially six more years?

I seriously doubt they will resign when Democrats are win control. They waited decades for a MAGA court, they aren’t just going to give it up.

1. IDK. They have pretty big egos, & lose clout if they leave the Court.

They just don't come across as "for the greater good" type of guys.

6. Guessing they'll do it if the bribe is big enough

Close to the election if polling continues to look grim for the GOP, I expect they will resign and it will take a lot to find out what their price was.

2. Resign, as Ginsburg should have done

Both Thomas and probably Alito will resign during trumpass's term; likely 2027 to avoid the 2028 election year debacle of 2024 where repubs denied Merrick garland.
I will foreever remember Ruth Bader Ginsburg not for what she did, but for what she did not do - resign under Obama when she had 8 years to do so, seems she wanted to set some dazzling longevity record for women justices. Thanks for nothing Ruth.

3. Continue to generally make poor rulings in the short term

They definitely won't resign before the end of the current term in June. As others have speculated due to scheduling a book release for October, Alito is a decent bet to retire.

I think Thomas is less likely to leave before he sets the longevity record which would be in August 2028. I think he wants that to kind of give himself a legacy since he's convinced everyone thinks he's bad because of affirmative action. Granted he's bad, but that's because he's an idiot with not because of affirmative action.

They'll stick around. They'll leave in 2028.

Even with Dem control, a "moderate" Conservative Trump appointee would get approved. I'm cynical like that.
