Supreme Court rules the Postal Service can't be sued, even when mail is intentionally not delivered

WASHINGTON (AP) A divided Supreme Court on Tuesday ruled that Americans cant sue the U.S. Postal Service, even when employees deliberately refuse to deliver mail.
By a 5-4 vote, the justices ruled against a Texas landlord, Lebene Konan, who alleges her mail was intentionally withheld for two years. Konan, who is Black, claims racial prejudice played a role in postal employees actions.
Justice Clarence Thomas, writing for a majority of five conservative justices, said the federal law that generally shields the Postal Service from lawsuits over missing, lost and undelivered mail includes the intentional nondelivery of mail.
In dissent, Justice Sonia Sotomayor wrote that while the protection against lawsuits is broad, it does not extend to situations when the decision not to deliver mail was driven by malicious reasons. Justice Neil Gorsuch joined his three liberal colleagues in dissent.

Lane. Konan leases rooms to tenants in both houses and
occasionally stays at them herself. The Postal Service de-
livers mail for all the houses in the neighborhood to a cen-
tral structure with a box for each house. The Postal Service
distributes keys to the owners of the houses so that they can
retrieve their mail. As the homeowner, Konan received the
keys to the boxes for both houses. Konan kept the keys and
distributed the mail to her tenants daily, and she also re-
ceived some of her own mail at the Saratoga address.
Konans grievances with her mail service began in May
2020. After Konan noticed that no mail had arrived at her
Saratoga house in several days, she learned that the as-
signed carrier had changed the listed owner from Konans
name to a tenants name. The same carrier then authorized
a change of the lock to allow the tenant to have his own mail
key without Konans consent. Konan confronted the em-
ployees at the local post office about these changes. A su-
pervisor at the local post office explained to Konan that the
Postal Service would stop delivering mail to her Saratoga
address until the Postal Service Inspector Generals office
investigated and determined the proper owner. Konan then
received no mail to the Saratoga address for a couple of
months before service resumed.
Konan then learned that the same carrier had mail ad-
dressed to her and her tenants returned to senders as un-
deliverable. As a result, Konan and her tenants did not
receive important mail. Konan resorted to private carriers.
The disruptions in mail service resulted in the loss of ten-
ants and made it more difficult for Konan to attract new
tenants. The carrier also taped a red notice inside the mail-
box stating that mail addressed to some, but not all, of the
Saratoga residents could be delivered to the box. In 2021,
postal workers also allegedly stopped delivering mail to the
Trenton house after discovering that Konan owned it as
well.
In response, Konan signed up for the Postal Services In-
formed Delivery service, which allows customers to view
scans of incoming mail. When she discovered that mail on
its way to her addresses was not being delivered, she re-
quested that the mail for the Saratoga residence be held at
the post office so that she could retrieve it in person. But
the postal employees did not give her the mail because Ko-
nan failed to provide identification for the addressees. In
addition to these efforts, Konan also filed administrative
complaints, but without success.
In January 2022, Konan sued the United States in fed-
eral court. Konan alleged that the Postal Service intention-
ally and wrongfully withheld her mail. As relevant here,
Konan brought claims under state law for nuisance, tor-
tious interference with prospective business relations, con-
version, and intentional infliction of emotional distress.
She sought damages for loss of rental income, the depriva-
tion of her rightful mail, and the distress that the postal
workers caused her.

(7,635 posts)I suppose there was a "religious" issue, wrapped up in the racial issue? Or maybe it was racial and gender related. They had to actively investigate to see if she owned anything else. No... I agree with Sotomayor... this goes beyond the broad immunity. We HAVE to start putting our feet down to these types of things. No more religious exemptions for doctors and pharmacists... for postal carriers, for county clerks, and who know who else? Wrong skin color? Sorry... you don't get citizen services. Wrong gender? Sorry... you don't get citizen services. Wrong religion? Sorry... you don't get citizen services.
It never stops... there's always another excuse waiting in the wings. This country, as it is now, will never be satisfied until the only people on its soil are white, christianist males. The rest of us can go to hell, for all they care.

(295 posts)Many states have vote by mail. What happens if Trump calls on all MAGA postal workers to stall delivery or destroy mailed ballots? They can now do this with impunity thanks to this Supreme Court ruling. All voters who once had faith that the US Postal Service would deliver their ballot should now deposit it into an official ballot drop box to be sure it gets to the Registrar's office. This regime is desperate and will do everything it can to gain an edge in the midterm elections. Don't think this postal dirty trick will be a random thing. They will flood the zone with many dirty tricks while they suppress the vote with gerrymandering and voter ID schemes.

To whom does mail belong once it is in the hands of the post office? These are physical objects that have an original creator and an intended recipient. It should belong to one of them with the post office only providing carriage. By choosing to not deliver the postal worker is taking the property of someone.
There may be other criminal charges that can be brought against other refusal of service acts with real world consequences.
It's not all torts. (if that is the right word. Not a Lawyer)

But you raise an interesting question whether or not an individual letter carrier or office worker can be criminally charged for this, or does the SC decision shield individuals from that too? And if the Postal Inspector responsible for policing this crime will just ignore it, or will such acts now even be rewarded by the Postmaster General? Maybe he runs a contest to see how many ballots they can steal and the winner gets some free Trump merchandise and worthless bitcoins.

(19,590 posts)I think that was settle many years ago when the FBI was using unpurchased copies of Word Perfect and dBase.
With the USPS that is why they had certified and registered mail and mail insurance. Because way back when mail was delivered by horseback it was never certain that the mail could be delivered. Even today mail can be destroyed when a mail truck is involved in an accident and the mail is destroyed.

(188 posts)GOP will use this as a tool for not delivering ballots timely received by USPS, to the county election dept. You know this will happen, even if ballots are dated and cancelled with date by USPS.

(15,766 posts)from the outside of the envelope. Granted, you could look up the voters party based on the return address, and make an educated guess. In theory, you could also check their social media to get a sense of how they would vote, as Cambridge Analytica did in 2016, and cull those ballots.
But just delaying all mailed ballots could hurt either party, with no sure way to know.

Because we're here because we never brought GW Bush SR to justice, nor did we do justice to Nixon. The R's keep getting away with everything, and so they push it further and further to get what they want... a right-wing, fascist christian male nation.
I've said for years we're going to have to have a court of reconciliation for when their reigns end. But we're going to need more of that... or more than that. I'm not sure, but I think my belief in the R party as a party first and foremost should be designated as a terrorist organization against the U.S. and then go from there. But then, I'm getting pretty mad at the stupidity I'm reading lately.
